- Acceptance of Terms
By accessing or using the Nemesis platform, including its mobile applications, website, marketplace, and related services (collectively, the “Services”), you agree to be legally bound by these Terms of Service (“Terms”). If you do not agree, you may not access or use the Services. - Description of Services
Nemesis provides a hybrid platform offering social networking, content sharing, creator tools, and a third-party marketplace connecting buyers and sellers. Nemesis is not the seller of goods listed on the marketplace and does not take ownership of user-listed products. - Eligibility
You must be at least thirteen (13) years old to use Nemesis. Certain features require users to be eighteen (18) years or older. You represent that all information provided is accurate and truthful. Nemesis may suspend or terminate accounts that violate these Terms or applicable laws.
- User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Nemesis is not liable for unauthorized account access resulting from user negligence.
- User Content
Users retain ownership of content they submit. By posting content, you grant Nemesis a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote such content in connection with operating the Services.
- Prohibited Conduct
You agree not to engage in unlawful activity, fraud, harassment, impersonation, deceptive practices, or any conduct that violates Nemesis policies, applicable laws, or the rights of others.
- Marketplace Rules
Sellers are solely responsible for product listings, pricing, fulfillment, refunds, and compliance with all laws. Buyers acknowledge that purchases are made directly from sellers, not Nemesis.
- Returns and Refunds
Buyers may request a return within fourteen (14) days of confirmed delivery, subject to item eligibility. Transaction funds are held pending settlement during the return window. If a return is approved, the buyer will receive a refund of the product price from pending funds. Sellers have forty-eight (48) hours to respond to return requests, after which returns may be automatically approved. Buyers are responsible for return shipping unless otherwise stated by the seller. Nemesis may intervene to prevent abuse.
- Payments and Settlement
Seller payouts and platform fees are not finalized until applicable return and dispute windows close. Payments are processed on a rolling settlement cycle, generally every sixteen (16) days or on the sixteenth (16th) day of the calendar month. Payout timing is not guaranteed.
- Fees
Nemesis may charge platform or service fees as disclosed at the time of transaction. All fees are subject to change at Nemesis’s discretion. - Intellectual Property
All Nemesis trademarks, logos, software, and proprietary materials are owned by Nemesis or its licensors and may not be used without prior written permission.
- Disclaimers
The Services are provided “as is” and “as available.” Nemesis makes no warranties regarding uninterrupted service, product quality, or user outcomes.
- Limitation of Liability
To the maximum extent permitted by law, Nemesis shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the Services or marketplace transactions. - Indemnification
You agree to indemnify and hold harmless Nemesis from claims arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.
- Dispute Resolution
Users agree to attempt informal resolution before pursuing binding arbitration, where permitted by law.
- Modifications
Nemesis may modify these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
- Governing Law
These Terms are governed by the laws of the applicable jurisdiction without regard to conflict-of-law principles.
- Entire Agreement
These Terms constitute the entire agreement between you and Nemesis concerning the Services.
